第一,居住与出入境权益。这是“五星卡”最基础的权益,根据法律规定,持有“五星卡”的外国人,在我国境内居留期限不受限制,无需再定期办理签证或居留许可。同时,凭“五星卡”与有效护照,可免签出入中国国境,无需再额外申请签证,极大便利了外籍人士的国际出行。在苏州本地,持卡人可单独使用“五星卡”办理住宿登记、购买车(船、机)票等需要证明个人身份的场合,无需再出示外国护照,无论是在苏州的酒店住宿,还是乘坐高铁、飞机出行,都与中国公民享受同等便利。王敏霞律师在此提醒,持卡人需注意,“五星卡”的有效期为未成年人5年、成年人10年,期满前1个月需及时申请换发,避免影响使用。

Hello everyone, I am Wang Minxia, a lawyer who has been practicing in Suzhou for many years and has long provided legal services for foreign-invested enterprises in the city. Since devoting myself to the legal service sector in Suzhou and focusing on legal affairs related to foreign-invested enterprises, I have met a large number of foreign friends working, starting businesses and living in Suzhou, many of whom are paying attention to the Five-Star Card — namely the new version of the Foreigner's Permanent Residence Identity Card of the People's Republic of China. As an open, inclusive city with a concentration of foreign capital, Suzhou attracts an increasing number of foreign talents to settle down. The Five-Star Card, as the core document for foreigners' long-term residence in China, carries rights and interests as well as relevant legal provisions that are directly related to the life and development of every cardholder, and are also closely linked to the foreign-invested enterprise clients I serve all year round. Today, from the perspective of a lawyer who has long provided legal services for foreign-invested enterprises in Suzhou, combined with national laws and local policies of Suzhou, I will give a comprehensive interpretation of the rights, interests and legal boundaries for foreigners who have obtained the Five-Star Card, helping every foreign friend in Suzhou clearly understand their own rights and enjoy the conveniences in the city in compliance with laws and regulations.
First of all, we need to clarify the legal status of the Five-Star Card. According to the Exit and Entry Administration Law of the People's Republic of China, the Measures for the Administration of Examination and Approval of Permanent Residence of Foreigners in China and other relevant laws, the Five-Star Card is a legal identity document issued by the National Immigration Administration to qualified foreigners after approving their permanent residence in China. The first is the employment category: if a foreigner holds a position such as deputy general manager or associate senior professional title or above in key institutions of higher learning, high-tech enterprises, encouraged foreign-invested enterprises and other units in Suzhou, has worked continuously for 4 years, resided in China for no less than 3 years in total within the 4 years, and has a good tax payment record, he or she can apply;
The second is the investment category: if a foreigner has made stable investments in Suzhou for 3 consecutive years with good tax payment, and has invested more than 500,000 US dollars in encouraged industries, he or she will meet the application conditions.
It should be noted that as a highland for foreign capital, Suzhou provides certain policy preferences for Five-Star Card applications for investments in encouraged industries. What core rights and interests can foreigners enjoy in Suzhou after obtaining the Five-Star Card? Combined with national laws and local policies of Suzhou, I have sorted them into six categories, each of which is closely related to daily life and work, and is also the most consulted content in my practice.
1. Residence and Entry-Exit Rights & Interests
This is the most basic right of the Five-Star Card. According to the law, foreigners holding the Five-Star Card have no restriction on their residence period in China and no longer need to apply for visas or residence permits regularly. Meanwhile, with the Five-Star Card and a valid passport, they can enter and exit China visa-free without applying for additional visas, greatly facilitating their international travel. In Suzhou, cardholders can use the Five-Star Card alone to handle accommodation registration, purchase train (ship, flight) tickets and other occasions requiring personal identity proof, without presenting a foreign passport. They enjoy the same conveniences as Chinese citizens whether staying in Suzhou hotels or traveling by high-speed rail and plane.

In Suzhou, foreigners holding the Five-Star Card enjoy the same employment rights as Chinese citizens, no longer need to apply for the Foreigners' Employment Permit, and can freely apply for positions in various enterprises and public institutions in Suzhou (except posts involving state secrets). Meanwhile, cardholders can start businesses independently in Suzhou and establish foreign-invested enterprises with simplified approval procedures, enjoying relevant local supporting policies for foreign-invested enterprises — a point I have deeply experienced in serving foreign-invested enterprises in Suzhou for years, with a clear understanding of the implementation details of various supporting policies.
In addition, if cardholders are talents in key supported industries in Suzhou such as artificial intelligence, they can also enjoy Suzhou's talent incentive policies. For example, senior managers and key technical backbones with an annual salary of more than 500,000 yuan can apply for a special reward of up to 400,000 yuan per year, with a cumulative total of no more than 1.2 million yuan.

According to relevant national regulations, foreigners holding the Five-Star Card can participate in China's social insurance in accordance with the law, including endowment insurance, medical insurance, unemployment insurance, work-related injury insurance and maternity insurance, enjoying the same social security benefits as Chinese citizens. In Suzhou, cardholders can go through insurance registration procedures at social security departments with the Five-Star Card, with the same payment standards and benefits as local Suzhou residents. They can receive pensions according to law after retirement and enjoy medical insurance reimbursement when ill.
In addition, according to Suzhou's housing fund policy, personnel from Hong Kong, Macao and Taiwan and foreigners with permanent residence status can participate in the housing fund system with reference to flexible employees. After paying the housing fund, they can enjoy relevant rights and interests such as housing fund loans and withdrawals, providing more guarantees for cardholders to purchase or rent houses in Suzhou.

In terms of education, the minor children of foreigners holding the Five-Star Card can enjoy the same treatment in compulsory education in Suzhou, enroll in nearby public schools without paying additional temporary study fees or school selection fees, and have access to the same educational resources as children with local Suzhou household registration. If their children need to receive senior high school or higher education, they can register and take examinations in accordance with relevant regulations, enjoying the same admission qualifications as children of Chinese citizens.
In terms of medical care, cardholders can seek medical treatment in various medical institutions in Suzhou with the Five-Star Card, enjoying the same medical services as Chinese citizens, and can use medical insurance to reimburse relevant medical expenses. They can also independently choose commercial medical insurance to further improve medical security.
5. Property and House Purchase Rights & Interests
The property rights and interests of foreigners holding the Five-Star Card in Suzhou are protected by Chinese laws. Their legitimate property such as income, real estate and vehicles enjoy the same ownership, inheritance and disposal rights as Chinese citizens. In terms of house purchase, cardholders can buy self-use and self-occupied houses in Suzhou without meeting restrictions such as "paying social security in Suzhou for a certain number of years", enjoying the same house purchase policies as local Suzhou residents.
Meanwhile, if cardholders are high-level talents recognized by Suzhou, they can also enjoy Suzhou's talent house purchase subsidies. For example, postdoctors who stay (come) to Suzhou to work in enterprises after leaving stations can get a 300,000 yuan house purchase subsidy; full-time doctors, masters from key universities and undergraduates newly introduced by artificial intelligence enterprises can get no less than 150,000 yuan, 100,000 yuan and 50,000 yuan house purchase subsidies respectively.
It should be noted that after purchasing a house, cardholders must go through property right registration in accordance with Suzhou's real estate management regulations. In case of real estate transactions, inheritance and other matters, they can consult a professional lawyer to ensure that their property rights and interests are not infringed.
6. Other Convenience Rights & Interests
In addition to the above rights and interests, foreigners holding the Five-Star Card can also enjoy many conveniences in Suzhou: they can apply for a motor vehicle driving license with the Five-Star Card without taking additional driving test subjects for foreigners; they can open bank accounts, apply for credit cards, apply for loans and other financial businesses in Suzhou's banks, enjoying the same financial services as Chinese citizens; they can participate in professional and technical qualification evaluations and examinations in Suzhou to obtain relevant vocational qualification certificates; they go through customs clearance as settled passengers with simplified procedures. In addition, cardholders can also enjoy exclusive talent services in Suzhou, such as conveniences in garden visits and transportation.

They shall not engage in activities endangering China's national security or harming social public interests; in case of fraudulently obtaining permanent residence qualification, illegal crimes and other circumstances, their permanent residence qualification will be cancelled according to law, and they may even be deported.
Based on my practice experience in Suzhou, many foreigners still have questions about relevant rights and interests after obtaining the Five-Star Card, such as "the difference between the Five-Star Card and a passport", "how to protect rights when rights and interests are infringed", "how family members can migrate with them". First, Misunderstanding 1: "Obtaining the Five-Star Card means becoming a Chinese citizen". In fact, the Five-Star Card is a residence permit, not a naturalization certificate. Cardholders still hold foreign passports and do not enjoy China's political rights.
Second, Misunderstanding 2: "The Five-Star Card is permanently valid". The Five-Star Card has a clear validity period, and cardholders must meet the residence time requirements, otherwise the qualification may be cancelled.
